(NewsNation) — Disney is trying to get a wrongful death lawsuit thrown out following a woman’s fatal allergic reaction at a restaurant within the Disney World complex. The company says the terms of use in a one-month subscription to Disney+ in 2019 prevent the woman’s widower from suing the company.
Trial attorney Misty Marris says she doesn’t think “you will find” a judge or an arbitrator who says it is “reasonable” that the buyer is signing away their right to be heard in a court of law “because you signed up for an app on your television.”
