(NewsNation) — Los Angeles County District Attorney Nathan Hochman has filed a motion to delay Thursday’s scheduled resentencing hearing for Erik and Lyle Menendez, citing a newly completed parole board risk assessment ordered by Gov. Gavin Newsom.
The last-minute filing on Wednesday comes after the DA’s office learned on April 15 that the parole board has completed its Comprehensive Risk Assessment Reports for the brothers, who were convicted of the 1989 shotgun murders of their parents, Deadline first reported.
“Although the People were directed not to disclose these reports due to the Governor’s Executive privilege and for other reasons, the Governor’s Office has invited the Court to request these documents for use at the resentencing hearing,” the DA’s motion states.
The resentencing hearing, scheduled for Thursday and Friday, could potentially overturn the life-without-parole sentences the brothers received in the 1990s. The hearing has been postponed multiple times due to various circumstances, including an incumbent being voted out of office and wildfires.
Former DA George Gascón had recommended resentencing for the brothers after renewed public interest following Netflix’s “Monsters: The Lyle and Erik Menendez Story” series last fall.
However, Hochman, who defeated Gascón in the election, withdrew that motion Mar. 10, stating the brothers continue to weave “a continuum of lies and deceit.”
The case took another contentious turn last week when the DA’s office displayed crime scene photos during a court presentation, prompting Menendez family members to seek an admonishment of the DA’s office for “scandalous behavior.”
The family claims the display of “horrific and gruesome photographs” led to the hospitalization of 85-year-old Terry Baralt, sister to the brothers’ father.
In addition to Thursday’s resentencing hearing, the Menendez brothers are scheduled for individual hearings before the parole board June 13, after which Gov. Newsom will decide whether to grant clemency.
