Harvey Weinstein to have retrial over rape charge in New York

(NewsNation) — Harvey Weinstein, the disgraced Hollywood movie mogul, will be tried for a third time in New York for sexual assault of Jessica Mann after a mistrial in June when the jury foreman said they would not continue deliberating on the charge of rape, NBC News reports.


Judge Curtis Farber said he would like the trial of the imprisoned film producer to start before the end of the year. He said, ““The case needs to be tried this year.” Mann is willing to testify again. Prosecutors requested a January date but Farber said that was too far off.

Weinstein was convicted of sexually assaulting “Project Runway” production assistant Miriam Haley in 2006. The jury found him not guilty of assaulting former runway model Kaja Sokola. 

The 73-year-old has denied all sexual assault and rape claims against him.

Sentencing for the verdict in Haley’s case is scheduled for Sept. 30. 

Harvey Weinstein’s attorney, Arthur Aidala, told NewsNation that, “The Manhattan District Attorney has the choice of dismissing the remaining count against Mr. Weinstein, the lowest level felony, and proceeding to sentence on the one count on which he was convicted. Instead they appear to be subjecting this complainant to yet another trial which even if successful will have a minimal impact on Mr. Weinstein’s ultimate sentence.”
