(NewsNation) — Sean “Diddy” Combs’ federal sex crimes trial is starting its sixth week.

Judge Arun Subramanian dismissed juror No. 6 on Monday for what he called “inconsistencies” and will replace the juror with an alternate, according to multiple reports.

“Taking these all together, the record raised serious concerns as to the juror’s candor and whether he shaded answers to get on and stay on the jury…

“The court should not, indeed cannot, let race factor into the decision of what happens. Here, the answer is clear. Juror No. 6 is excused,” the judge said.

The prosecution raised the issue last week, citing a lack of candor by the juror, who is a Black man.

In a letter over the weekend, the defense wrote that if the juror were to be removed, they “request that a mistrial be declared.”

Judge Subramanian said, “There has been no evidence of prosecutorial misconduct brought to the court’s attention. Zero.”

The juror was splitting his time between New Jersey and New York, but gave inconsistent answers about where he was residing. He said he “recently moved to New Jersey” and that he moved in with his girlfriend. He said the situation “may not be permanent, but this is where I’ve been staying.”

The prosecution said they anticipate to rest this week.

On Monday, Ananya Sankar, a paralegal who testified as a summary witness for the government, testified. She reviewed a large volume of cell phone texts and call logs from data extractions.

In texts presented by Sankar from December 2023 from Combs’ former girlfriend, who testified under the pseudonym “Jane” to the hip-hop mogul’s chief of staff, Kristina Khorram, she wrote, “(Combs) just threatened me about my sex tapes that he has on two phones. He said he would send them to my baby daddy.”

‘Jane’ said she was heavily drugged in sex tapes: texts

The influencer noted in her texts to Khorram that she was very drugged in the sex tapes.

During Jane’s marathon testimony, she said on the stand that she participated in drug-fueled sex parties under the demand of the rapper. She would engage in unprotected sex with male sex workers, with Combs watching and instructing them.

Combs faces federal sex trafficking and racketeering charges. The 55-year-old has pleaded not guilty.
